These Terms of Service ("Terms") govern your use of https://shop.fuelamericacoffee.com/ and purchases from Fuel America LLC. By using the Store or placing an order, you agree to these Terms and the policies referenced in them.

Eligibility and accounts

You must be legally capable of entering a binding agreement in your jurisdiction to place an order. You are responsible for providing accurate information and for maintaining the security of your customer account. Notify us at info@fuelamerica.us if you believe your account has been used without authorization.

Products and orders

We make reasonable efforts to display products, packaging, descriptions, and colors accurately. Packaging and seasonal coffee components may change while the essential product remains as described.

All orders are subject to acceptance, availability, and payment authorization. We may refuse or cancel an order for legitimate reasons, including suspected fraud, pricing or listing errors, product unavailability, or shipping restrictions. If we cancel a paid order, we will refund the affected amount.

Prices and payment

Prices are shown in U.S. dollars unless stated otherwise. Taxes, shipping charges, discounts, and the final order total are displayed during checkout. You authorize the applicable payment provider to charge the payment method you submit.

Shipping, returns, and refunds

Shipping and delivery are governed by our Shipping Policy. Returns, replacements, cancellations, and refunds are governed by our Return and Refund Policy. These policies are incorporated into these Terms.

Subscriptions

Subscription purchases automatically renew at the frequency and price disclosed before checkout until canceled. By purchasing a subscription, you authorize recurring charges to your payment method. Subscription management and cancellation are governed by our Purchase Options and Subscription Cancellation Policy, which is incorporated into these Terms.

Acceptable use

You may not use the Store to violate law, infringe intellectual-property or privacy rights, transmit malicious code, interfere with Store security or operation, scrape or access the Store through unauthorized automated means, impersonate another person, submit false information, or engage in fraudulent or abusive activity.

Intellectual property

The Store and its content, including Fuel America names, logos, product names, photographs, text, graphics, and design, are owned by or licensed to Fuel America and are protected by applicable intellectual-property laws. You may use the Store for personal, noncommercial shopping purposes. No other license is granted without written permission.

Third-party services and links

The Store relies on Shopify and other third-party services and may link to third-party websites. Third parties operate under their own terms and privacy practices. Fuel America is not responsible for third-party websites or services outside our control, except to the extent responsibility cannot be excluded by law.

Disclaimers

To the fullest extent permitted by law, the Store and its content are provided on an "as available" basis. We do not guarantee uninterrupted or error-free access. Product descriptions are informational and are not medical advice. Coffee contains caffeine unless specifically identified as decaffeinated.

Nothing in these Terms excludes warranties, remedies, or rights that cannot legally be excluded.

Limitation of liability

To the fullest extent permitted by law, Fuel America will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Store or a purchase. Fuel America's aggregate liability relating to a product order will not exceed the amount paid for the order giving rise to the claim. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

Indemnification

To the extent permitted by law, you agree to indemnify Fuel America against third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Store or material violation of these Terms.

Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where mandatory consumer-protection law in your jurisdiction applies.

Changes

We may update these Terms by posting a revised version with a new "Last updated" date. Changes apply prospectively unless otherwise stated or required by law. Material changes affecting an existing subscription will be communicated when required.

Severability and waiver

If a provision of these Terms is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
